Tsaka RSA’s Legal Troubles Deepen as State Moves to Add Statutory Rape Charge

Lekompo musician and social media personality Tsaka RSA’s legal troubles have deepened after prosecutors revealed that they intend to add a statutory rape charge to the cases already hanging over him.

The 29-year-old entertainer, whose full name is Nkgodisheng Paul Madubanya, appeared briefly before the Polokwane Magistrate’s Court on Monday, 19 October 2026.

During the proceedings, State prosecutor Mangope Digoro informed the court that the prosecution planned to add two charges to Tsaka’s case. These include statutory rape and failure to store a firearm in a prescribed safe.

The latest development interrupted Tsaka’s scheduled bail application and prompted his lawyer to request more time to study the additional allegations.

Alleged offence took place in Capricorn District

According to information presented in court, the alleged statutory rape incident occurred on 6 June 2026 in the Capricorn District of Limpopo.

However, the State has not publicly revealed the identity or age of the complainant. Authorities have also not disclosed the full circumstances surrounding the alleged offence.

Tsaka has not yet been convicted of any crime linked to the new allegation. Therefore, he remains presumed innocent unless the prosecution proves its case beyond a reasonable doubt.

His legal representative, identified in court as Advocate Tibane, asked for a postponement so that the defence could consider the proposed charges and prepare an appropriate response.

Consequently, Magistrate Mpho Hadebe postponed the matter to Wednesday, 21 October, when Tsaka is expected to launch a formal bail application.

He will remain in custody until his next court appearance.

Firearm arrest started latest legal battle

Tsaka’s current detention initially followed his arrest at his Rethabile Gardens home in Polokwane on 9 October.

According to the National Prosecuting Authority, police acted on information that the musician allegedly possessed an unlicensed firearm. Officers subsequently searched his property and allegedly recovered a firearm and ammunition.

The State initially charged him with unlawful possession of a firearm and unlawful possession of ammunition.

Separate media reports claim that the weapon’s serial number had been removed and that police found 52 rounds of ammunition. The State has now indicated that it also wants to charge him with failing to keep a firearm in a prescribed safe.

A ballistic examination could become important as the case progresses. Tsaka’s lawyers previously challenged the State’s decision to treat the firearm matter as a Schedule 5 offence, arguing that prosecutors had not yet produced a ballistic report confirming the weapon’s classification.

The prosecution has indicated that it will oppose his release on bail.

Separate crimen injuria case continues

In addition to the Polokwane case, Tsaka is facing a separate crimen injuria charge before the Lebowakgomo Magistrate’s Court.

That case reportedly follows a complaint lodged in 2025 over vulgar and insulting comments allegedly directed at a Thobela FM presenter on social media.

Tsaka appeared in the Lebowakgomo court on 13 October before that matter was postponed to 23 October for a formal bail application.

Crimen injuria generally involves unlawfully and intentionally violating another person’s dignity or privacy. However, the State will still need to prove the specific allegations against Tsaka during the relevant court proceedings.

As a result, the Lekompo entertainer could appear in two different courts within days as his legal team deals with separate criminal cases.

Controversial online personality faces growing scrutiny

Tsaka has built a public profile through Lekompo music, online videos and outspoken social media commentary. Originally from Ga-Mashashane, he has attracted a following through his music and provocative internet personality.

However, his online remarks have also repeatedly placed him at the centre of controversy. Some of his posts and interviews have reportedly included insults directed at broadcasters, celebrities and public figures.

Previous reports also drew attention to a social media video in which he appeared to be drinking and dancing with young girls. Nevertheless, there has been no official confirmation connecting that video to the statutory rape charge announced in court. The two issues should not be treated as related unless prosecutors place such evidence before the court.

Furthermore, social media speculation cannot replace evidence tested through the judicial process.

Bail application now becomes more complicated

The addition of a serious sexual-offence allegation could make Tsaka’s bail application more complex. The court will have to consider the nature of all the charges, the strength of the preliminary evidence and whether releasing him could affect witnesses or ongoing investigations.

Meanwhile, the defence will have an opportunity to challenge the allegations and present reasons why Tsaka should be released while awaiting trial.

The Polokwane Magistrate’s Court is expected to receive further information when the matter returns on Wednesday. Until then, Tsaka remains behind bars as the charge sheet against him continues to grow.
