WC Premier Winde doesn’t have the powers to arrest Putin, says Legal expert

Western Cape Premier Alan Winde’s insistence that he will have Russian President Vladimir Putin arrested is wishful thinking, the SA Communist Party said.

Earlier this week, Winde said provincial law enforcement officers would arrest Putin should he set foot in the province.

The SACP said the premier should rather focus his attention on rampant crime in the province.

Meanwhile, legal expert William Booth said the premier doesn’t have powers to effect an arrest on a warrant issued by the International Criminal Court.

“Police in this province actually fall under the authority of the national minister…,” he said.

Booth added that South Africa was obligated to perform its duties as a member of the ICC.

“South Africa is the signatory to the Rome Statute and the Rome Statute governs the whole issue of the International Criminal Court. If you are a signatory to a legislation, then obviously you should give effect to the legislation I think. The hope is that the national government will be doing the necessary, or not allow Putin into the country.”
