Televangelist Timothy Omotoso is back in court on Tuesday.
The rape accused is set to apply for leave to appeal a December ruling dismissing his application for a mistrial.
A prosecutor in the trial was found to have committed irregularities and ordered not to prosecute the matter further.
But the presiding judge found the irregularities were not enough to call for a mistrial.
Omotoso and his co-accused are facing ninety-seven charges, including rape, human trafficking, and racketeering.
The pastor has been behind bars since 2017.
