Advocate Paul Pretorius applied for a postponement and condonation at the Zondo commission on Monday.
Former Independent Police Investigative Directorate boss Robert McBride was expected to testify at the inquiry.
Pretorius says McBride’s failure to appear before the commission was caused by a mistake on the part of the commission’s legal team.
This comes after they failed to issue notices to people implicated on the matter.
Political analyst, Karima Brown says this is a symptom of a flaw in the administrative capacity of the commission.
The proceedings are expected to resume on Thursday when McBride is expected to testify.
