EFF’s legal challenge over Parliament suspension faces dismissal

The Western Cape High Court has found that the approach adopted by EFF leader Julius Malema and other senior EFF MPs in their challenge to review the disciplinary process from which they were ultimately suspended for 30 days from parliament was “hardly set out with the clarity required to bring such a challenge”.

Malema, his deputy Floyd Shivambu, Secretary- General Marshall Dlamini as well as Sinawo Tambo, Mbuyiseni Ndlozi and Vuyani Pambo sought to challenge their suspension.

They were found guilty of contempt of Parliament in a disciplinary process by the Powers and Privileges Committee for storming the 2023 State of the Nation Address by President Cyril Ramaphosa.

The said EFF MPs contended that the current rules permit a process that is unreasonable, procedurally unfair and vulnerable to majoritarian abuse.

The full bench, in a unanimous judgment, however, held a different view finding that the committee’s process and conduct were not unlawful adding that the procedural grounds which formed the basis of the applicants’ review all stand to be dismissed either based on the absence of legal justification or the very conduct of the applicants.
