
Award-winning Amapiano hitmaker DJ Maphorisa is currently facing a major legal battle with the South African Revenue Service (Sars) over a disputed tax bill reportedly amounting to R3.3 million. The popular producer and DJ, whose real name is Themba Sonnyboy Sekowe, has taken legal action after attempts to resolve the issue outside of court fell through.
According to reports by Sunday World, the high-profile tax dispute has now escalated to the South African Tax Court in Johannesburg. Court documents outline how the case unfolded, shedding light on the financial and legal pressures facing one of the country’s most successful music stars.
The conflict between DJ Maphorisa and Sars dates back to July 2018, when the revenue authority notified the star of its intention to conduct an income tax audit. Sars claimed that Maphorisa had not submitted his income tax returns for several years, prompting a deeper investigation into his financial affairs.
Sars Initiated an Income Tax Audit Against DJ Maphorisa
The tax agency requested supporting documentation, including IRP5 and IT3 certificates, investment income statements, and bank records. These documents were meant to clarify the sources of income and ensure that all taxable earnings were properly declared.
During a pre-trial conference, DJ Maphorisa reportedly admitted that his tax returns were eventually filed, but only after the audit had already commenced. He explained to officials that mental health challenges had contributed to delays in meeting his tax obligations.
After completing the audit, Sars raised questions regarding funds that were deposited into DJ Maphorisa’s FNB account. The revenue authority argued that these funds formed part of his undeclared gross income, and therefore should have been reported for tax purposes.
In November 2018, Sars issued formal findings alleging that the artist had intentionally evaded tax. As a result, it imposed a severe 200% understatement penalty on the assessed amount.
Court documents reportedly state:
“The respondent has proven the facts relied upon to impose the USP (understatement penalties) at the rate of 200% on the basis that the appellant’s conduct is correctly classified as intentional tax evasion.”
By December 2018, Sars finalized the audit using the available banking data after Maphorisa allegedly failed to respond to its findings. The assessments raised by the tax authority amounted to more than R3.3 million in unpaid taxes and penalties.
In 2022, several years after the initial audit, DJ Maphorisa filed formal objections to dispute the tax assessments for the 2015 to 2017 tax years. He maintained that Sars had miscalculated his tax liability and did not adequately consider his business expenses and deductions as a performing artist and music producer.
Despite his objections, Sars dismissed his claims, standing firm on the initial findings and penalties. This dismissal led the Amapiano star to escalate the matter further by lodging an official appeal in September 2022.
In his appeal, Maphorisa challenged both the accuracy of the tax calculation and the fairness of the 200% penalty imposed. He argued that the understatement penalty was unreasonable and did not take into account his circumstances or the explanations he provided.
The case is now before the South African Tax Court, where DJ Maphorisa is fighting to have the multi-million-rand tax bill overturned. Legal experts note that such cases can be complex, often involving detailed financial records, expert testimony, and negotiations over penalties and interest.
If the court rules in favor of Sars, the producer may be required to pay the full R3.3 million, including penalties. However, if Maphorisa succeeds, the assessments could be reduced or overturned, potentially saving him millions of rands.
