ConCourt rules Parliament can continue with impeachment process against Busisiwe Mkhwebane

The Constitutional Court has paved the way for Parliament to continue its impeachment process against Public Protector Busisiwe Mkhwebane.

In a unanimous decision, the court sided with National Assembly Speaker, Nosiviwe Mapisa-Nqakula and the Democratic Alliance.

The apex court found that it is permissible to appoint a judge to the independent panel set up to investigate Mkhwebane’s fitness to hold office.

After Mkhwebane’s minor victory in the High Court, the speaker and the DA applied for a direct appeal on an urgent basis.

This was granted by the Constitutional Court.

The court agreed with the High Court that Mkhwebane should have the right to legal representation.

This right was limited in the newly drafted rules occasioned by the complaints of misconduct and incompetence

But Mkhwebane lost her cross-appeal in its entirety.
