Cape High Court dismisses liquor ban case

The local wine industry has been dealt another blow in court. Wine producers’ representative, Vinpro, challenged the constitutionality and lawfulness of the alcohol bans. It said it’s disappointed with the Cape High Court’s dismissal of its application.

Vinpro argued national government did not have the jurisdiction to impose the restrictions. Supported by the Western Cape Government, it said the restrictions should be in the hands of provinces.

The court agreed with government, saying the bans were reasonably necessary. It found national government was acting well within its rights. Vinpro said there is now uncertainty in the industry.
