AfriForum says banning apartheid flag tantamount to censorship

AfriForum says banning the old apartheid flag is tantamount to censorship.

The lobby group is making its submissions before the Supreme Court of Appeal in Bloemfontein.

It wants a 2019 ruling in the South Gauteng High Court overturned.

The court banned the display of the 1928 flag, saying it amounts to hate speech but Afriforum disagrees.

Afriforum’s legal representative Mark Oppenheimer said: “You protect speech that is controversial, that is offensive…even speech that instils fear in people.

“If you allow [a] hundred people to wave their flag you can know who they are, get their sense of temperature in society…there are a plethora of ways that can be used to remove the hatred, to have reconciliation without resorting to censorship.”
