Public Protector Busisiwe Mkhwebane’s interdict application dismissed by WC High Court

The Public Protector has suffered another blow from the courts. This time against Parliament. The High Court in the Western Cape has dismissed her urgent application to stop a probe into her fitness to hold office.
The Public Protector had argued the new rules are unconstitutional.

Judge Vincent Saldanha said an impeachment process of an office-bearer of a Chapter 9 institution should not be taken lightly.
The judge said the court should not interfere unless the applicant demonstrates “exceptional circumstances”, which in his view the Public Protector has failed to do.
Public Protector also ordered to pay the costs of the National Assembly, including costs of two or three counsel.
