The court case, in which survivors of the Marikana massacre are facing off against President Cyril Ramaphosa and Sibanye Stillwater, is expected to get off to a rocky start on Friday.
Lawyers for the survivors are calling for the recusal of Judge Colin Lamont.
They say he is compromised because he owns shares in Sibanye-Stillwater worth more than R200,000.
The JSE-listed mining group bought Lonmin in 2019.
At least 34 mineworkers were killed during the Marikana Massacre in August 2012 and several others were seriously injured.
They were demanding a salary of R12,500 and improved living conditions.
