Nandipha Magudumana denied permission to appeal arrest ruling

Nandipha Magudumana’s application for leave to appeal has been dismissed with costs. She argued the court erred when it ruled her arrest and subsequent deportation from Tanzania was legal. But Judge Phillip Loubser says he does not think a different court would come to a different conclusion.

“Having regard to all the submissions made on behalf the applicant in present application for leave, I am of the view that those submissions cannot be successful in light of the findings of facts made by this court in the application launched by the applicant,” he said.

“I am therefore not persuaded that another court would come to a different conclusion or that there are other compelling reasons why the matter should proceed on appeal. The following order is therefore made, the application for leave to appeal is dismissed with costs.
