NPA denies dragging their feet on Malema & Ndlozi prosecution

The NPA has denied delaying the prosecution of the EFF leader and spokesperson on charges of common assault.

Julius Malema and Mbuyiseni Ndlozi made their first appearance at the Randburg magistrate’s court on Wednesday.

They are accused of assaulting a police officer who refused to allow their vehicle into the cemetery during the funeral of Winnie Madikizela-Mandela.

AfriForum said the NPA is only prosecuting the pair after it wrote to them, threatening private prosecution.

The footage in question appears to show Malema and Ndlozi assaulting a police officer, but Malema denies that he assaulted anyone.

“I’ve never done that. If I laid a hand on him I would have panel-beated him,” Malema said.

He has accused the NPA of kowtowing to AfriForum by proceeding with charges against him.

AfriForum says the case is about equality before the law and protecting the NPA from political interference.

The NPA said the delay wasn’t malicious, only procedural.

NPA spokesperson Phindi Mjonondwane said there were outstanding investigations that needed to be concluded before a decision could be made.

“That has nothing to do with… AfriForum.”

The pair will reappear in March 2020 when the trial will get underway.
