Magudumana Still an Accused in Thabo Bester Prison Escape Case Following SCA Ruling

Disgraced medical practitioner Nandipha Magudumana will remain on the list of accused in the high-profile Thabo Bester prison escape case after the Supreme Court of Appeal (SCA) dismissed her appeal on Friday. The decision by the SCA reinforces her legal standing as a central figure in one of South Africa’s most shocking criminal sagas.
Magudumana had approached the SCA seeking to have her arrest and return to South Africa from Tanzania declared unlawful. She argued that her deportation was procedurally flawed and effectively amounted to an unlawful extradition. However, in a majority ruling, the court sided with the State, dismissing her appeal and confirming that she must face trial.
The judgment marks a significant legal setback for Magudumana, who had hoped that a ruling in her favor would lead to her removal from the list of accused persons in the case involving her partner and co-accused, convicted rapist and murderer Thabo Bester.

Magudumana was arrested in April 2023 alongside Bester in Arusha, Tanzania, after the couple fled South Africa. Bester had escaped from the Mangaung Correctional Centre in May 2022, faking his death in a staged prison fire. He was serving a life sentence for rape and murder at the time.
The couple’s dramatic flight and subsequent capture drew nationwide attention and revealed a complex web of corruption, manipulation, and high-level breaches in prison security. The State contends that Magudumana played an active role in orchestrating the escape and aiding Bester’s movements while he was a fugitive.
Following their arrest, Tanzanian authorities handed Magudumana and Bester over to South African officials. Magudumana’s legal team later challenged the legality of her deportation, calling it a “disguised extradition” that violated international law and South Africa’s legal procedures.
While the majority of the SCA bench rejected Magudumana’s arguments, one of the five judges, Justice Tati Makgoka, dissented. In his minority opinion, Makgoka held that the process by which Magudumana was returned to South Africa lacked legal foundation and amounted to an unlawful extradition.
Makgoka pointed out that there was no formal extradition request or process initiated by South African authorities. Instead, he argued, the handover of Magudumana by Tanzanian officials to South African immigration authorities contravened international legal norms.
“The manner in which Magudumana was brought back into the country was not only irregular but unlawful,” Makgoka stated in his judgment. He emphasized that such conduct undermines established procedures for international cooperation in criminal matters.
Had Makgoka’s view been shared by the majority, Magudumana would have succeeded in her appeal, potentially removing her from the list of accused and casting doubt on the legitimacy of the State’s case against her.
With the SCA’s majority decision confirming that her arrest and return were lawful, Magudumana is now set to stand trial alongside other accused in the Free State High Court in July. The charges against her include assisting an escapee, fraud, defeating the ends of justice, and violating multiple criminal and correctional laws.
The upcoming trial is expected to shed further light on the intricate planning and execution of Bester’s escape and Magudumana’s alleged role in aiding and abetting the convicted murderer. Her continued presence on the accused list ensures that her actions and motivations will be closely scrutinized in court.
