ConCourt to hear State’s appeal against judgment to recognise Muslim marriages

The Constitutional Court is set to hear an application by the Women’s Legal Centre on Muslim Marriages on Thursday.

It wants the apex court to confirm an order by the Supreme Court of Appeal legally recognising Muslim marriages. It also wants certain sections of the Divorce Act declared unconstitutional.

The State is not opposing the confirmation application but says it must be limited to Muslim marriages terminated either by death or divorce before the date of the order.
