ATM suggests guilty finding against Busisiwe Mkhwebane can be challenged and won

One of Busisiwe Mkhwebane’s biggest supporters, the African Transformation Movement (ATM), said anyone can legally challenge the Section 194 inquiry and win.
ATM member of Parliament (MP) Vuyo Zungula said the committee did not treat her fairly and was highly likely to face another court challenge as it finalizes the inquiry.
Zungula was reacting to MPs after the inquiry found Mkhwebane guilty of misconduct and incompetence on several charges.
Zungula said developments in the Section 194 inquiry were evidence that Mkhwebane did not have a fair hearing.
He said the committee had predetermined outcomes and Mkhwebane wasn’t treated fairly.
“There’s a clear court order that directs Parliament that any inquiry that is held, advocate Mkhwebane must be afforded legal representation.”
He said any legal challenge against the findings would be successful.
“In our view Advocate Mkhwebane and any person that supports her could actually go to court and win.”
Zungula, who has been absent from the inquiry, said he won’t legitimize the process with his attendance.
The inquiry is compiling its draft report that will be sent to Mkhwebane for her response.
