Fees Must Fall activist Bonginkosi Khanyile is expected in the Durban magistrate’s court on Tuesday.
This after he failed to appear in December but later produced a doctor’s note.
Khanyile is charged with incitement to commit public violence during last year’s July unrest.
He also faces a charge relating to alleged violations of regulations put in place during the Covid-19 lockdown.
The unrest saw more than 300 people killed in Gauteng and KwaZulu-Natal and businesses torched and looted.
