Afriforum denied leave to appeal apartheid flag ruling

Afriforum has been denied leave to appeal a ruling declaring the gratuitous display of the apartheid flag hate speech.
The Nelson Mandela Foundation applied to the court to declare the display of the old flag hate speech.
It argued its display constitutes unfair discrimination and harassment based on race.
AfriForum challenged the move, saying this is a violation of freedom of speech.
In his judgment, Judge Phineas Mojapelo said those who gratuitously display the old flag embrace hatred but indicated the use of the flag should be allowed for academic and other uses with justification.
Mojapelo determined that the court order applied nationally and not just in Gauteng.
