Nono Maloyi asked her to remove his culpable homicide charge from the role.
The charge relates to a 2018 car crash which left a woman dead.
They were withdrawn pending the NDPP’s decision.
Delegates at the weekend conference called for Maloyi to step aside because of the unresolved case.
He refused as they were withdrawn, going on to oust Bushy Maape.
Maloyi says he will step aside if asked to, but maintains the charge is not serious enough for the rule.
