The National Energy Regulator of South Africa (Nersa) will appeal the High Court’s decision allowing Eskom to implement a phased recovery.
This judgment will see the struggling power utility recover R69-billion over three-years resulting in tariff increases.
It’s imperative that it is appealed…we basically simply say the judge erred and it was a serious overreach,” said Nhlanhla Gumede, the head of electricity regulation at Nersa.
The first of Eskom’s tariff increases should take place from April next year, if everything goes according to plan, according to the power utility.
The High Court found that Nersa acted illegally when deducting a R69-billion equity injection into Eskom.
