Luyanda Botha not guilty of attempted rape of nursing student

Luyanda Botha, a convicted rapist and murderer serving a life sentence, has been acquitted of the attempted rape of a nursing college student nearly a decade ago.

The Wynberg Regional Court delivered its judgment on Monday, clearing Botha of the charges related to an alleged incident at Athlone Nursing College in June 2014. Magistrate Anthea Ramos stated that the court had to objectively assess whether Botha’s actions demonstrated intent to commit rape.

The ruling concluded that the case against Botha had not been proven beyond a reasonable doubt. This legal standard, requiring certainty of guilt, played a pivotal role in the decision to acquit him.
