Police arrested the wrong men in Khayelitsha barbershop shooting case, court told

Lawyers for the two men linked to the Khayelitsha mass shooting in June have told the court that the police arrested the wrong men.

Athule Mtsha and Sithisa Masiko appeared before the Khayelitsha Magistrate’s Court on Tuesday to apply for bail.

The State is accusing them of killing four people, including three children at a barbershop in Site C in early June.

The State has told the court that a witness positively identified the pair as shooters in the incident.

Lawyers for both accused have presented alibi defences for their clients in the bail application.

Mtsha’s lawyer told the court that his client was driving his mother’s minibus taxi on the day of the shooting.

According to the State, a white minibus taxi was seen by witnesses at the crime scene.

However, Mtsha’s lawyer said a car tracking report attached to his bail application affidavit revealed that he was not in the vicinity at the time.

Meanwhile, Masiko’s lawyer also told the court that his client was nowhere near the barbershop when the shooting happened.

He said a transaction made by his client showed that he was in Brackenfell at the time of the incident.

The case was postponed to next week Wednesday.
