Freedom Under Law joins fight against John Hlophe’s JSC appointment

Non-Profit organisation, Freedom Under Law has launched an urgent application before the Western Cape High Court against the designation of uMkhonto weSizwe party Parliamentary leader Dr John Hlophe.

The organisation is now one of three that have opposed the National Assembly’s election of the impeached Judge President.

It says Hlophe’s participation in the JSC would call the integrity of its processes into question, as well as undermine the independence of the judiciary. It adds that Hlophe remains unrepentant after his impeachment earlier this year.

Freedom Under Law submits that Hlophe’s designation to the Judicial Service Commission undermines the principles that fundamentally underscore the independence of the judiciary.

It argues that the National Assembly’s decision was incompatible with its obligations in the Constitution which prescribes that organs of state must assist and protect the courts to ensure their independence and impartiality among others.

The organisation says the National Assembly’s decision was irrational and wants it to be reviewed, set aside, and referred back to the National Assembly for consideration in accordance with the principles set out in the court’s judgment.
