The Western Cape High Court has made a ruling on ongoing land evictions in the City of Cape Town.

The Human Rights Commission was the first applicant in the case, assisting Bulelani Qolani.

Qolani was dragged n@ked from his temporary home in Khayelitsha.

The court ruled that any private contractor appointed by the city can’t evict or demolish any informal dwelling during the national state of disaster unless they obtain a court order.

Contractors are also prohibited from using excessive force and destroying or confiscating materials belonging to evictees.

The city has been ordered to return all building materials and pay R2,000 to those claiming compensation.
